Consent for DNA testing isn’t just a formality; it’s a legal and ethical requirement designed to protect individuals’ privacy and autonomy.

In the US, DNA testing is regulated to ensure that all parties involved understand and agree to how their genetic information will be used. This is because DNA contains highly personal data that can reveal details about a person’s identity, family relationships, and genetic predispositions.

Laws like the Genetic Information Nondiscrimination Act (GINA) and the Health Insurance Portability and Accountability Act (HIPAA) also protect individuals’ genetic privacy and prohibit the unauthorized sharing of genetic information.

In this blog, we’ll explore why consent is required for DNA testing, and who can provide consent for DNA testing.

Why is consent needed for DNA testing and who can provide it?

Consent is an essential part of the DNA testing process, allowing individuals taking part in the test to decide how their genetic information is used.

The question of who can provide consent for DNA testing depends on the age, legal status and relationship of the individuals involved in the test.

For an AlphaBiolabs DNA test:

• Adults must register their test online and provide their own consent (electronic signature) before their DNA samples can be used for testing

• For any minor(s) taking part in the test, a parent or legal guardian MUST register the test and provide consent on each minor’s behalf. Details of the person providing consent must be given when registering the test using our online registration form.

  By providing consent on behalf of a minor, you are making a legal declaration that you have the lawful right to sign on that minor’s behalf for the test that has been ordered.

• Deceased individuals: when a DNA test is needed using DNA samples from a deceased person (e.g. to settle an inheritance dispute or to verify a biological relationship to a family member who has passed away), a person with legal authority or a ‘qualifying relationship’ to the deceased may provide consent on their behalf. Qualifying individuals often include a spouse, parent, or another close family member.

If AlphaBiolabs does not have each person’s explicit consent – including for any minor(s) taking part in the test – we cannot perform the DNA test.

Is it legal to test someone’s DNA without their knowledge?

Performing a DNA test without consent is considered unlawful across the US and can carry serious legal consequences.

As a reputable, ISO 17025 and BBB-accredited DNA testing laboratory, we have been asked many times about the options for ‘discreet’ DNA testing.

Discreet DNA testing can have several meanings, from the test being sent to your address in discreet, plain packaging to the delivery of your test results in a secure, confidential way.

It can also refer to the method of collecting the DNA samples. For example, if you wanted to perform a paternity test on a minor, an alternative method of DNA sample collection such as a toothbrush DNA test or a nail clipping DNA test could be used for a more discreet method of sample collection.

However, consent must still be provided by/on behalf of each person taking part in the DNA test, regardless of the testing method.
